In a contracts action arising from a dispute between plaintiff investors and defendant fund administrator, the trial court's grant of summary judgment to defendant is affirmed in part and reversed in part where: 1) undisputed material facts establish that defendant administrator did not breach the applicable contract; but 2) the provision relied upon to award $3,027,237.96 in attorney's fees to defendant was a third party indemnification provision and did not create a right to prevailing party attorney fees.
