In a petition to redesignate two felonies as misdemeanors pursuant to Proposition 47, where defendant was sentenced and convicted for ten felonies, all arising out of a take-over bank robbery, the trial court's denial of the petition is: 1) reversed, where the gang enhancements did not disqualify defendant from relief; and 2) remanded with directions to allow defendant to file an amended petition, where defendant failed to carry his burden to show that the two felonies involved property worth $950 or less.
