California Court of Appeal
Anderson Union High Sch. Dist. v. Shasta Secondary Home Sch., 078491
In a case presenting an issue of statutory interpretation of the scope of the geographic restrictions for the operation of charter schools in the Charter Schools Act, sections 47605(a)(1) ad 47605.1, the trial court's judgment in favor of the charter school is reversed where the comprehensive statutory scheme governing charter schools does not permit a charter school -- that is authorized by a school district and provides support for nonclassroom-based independent study -- to locate a resource center outside the geographic boundaries of the authorizing school district but within the same county.
