Hall v. Super. Ct., 068516

In a petition for writ of mandate brought by a plaintiff who had his driver license revoked by the DMV after being arrested for driving under the influence and refusing to submit to a chemical test for blood alcohol content, and during the pendency of the petition the DMV hearing officer who upheld the revocation pleaded guilty in federal court to taking bribes in exchange for giving favorable treatment to persons arrested for driving under the influence, the trial court's order remanding the case to the DMV for a new administrative hearing is affirmed where a DMV hearing officer who admits to taking bribes for nearly a decade does not meet the constitutional standard of impartiality.
