In the People's appeal of the trial court's grant of a Proposition 47 petition to redesignate a prior felony conviction as a misdemeanor under The Safe Neighborhoods and Schools Act, Pen. Code section1170.18, the grant of petition is affirmed where the trial court did not erred by: 1) reaching the merits when defendant failed to satisfy her initial burden by attaching evidence to her petition; or 2) concluding defendant was eligible for relief when her conduct could have been punished as felony burglary even after Proposition 47, because she entered Sears with the intent to commit conspiracy.
