California Court of Appeal

Esparza v. Kaweah Delta District Hosp., 071761

In an appeal raising a question about the facts a plaintiff must allege to adequately plead he or she complied with the claims presentation requirement of the Government Claims Act, the trial court's judgment of dismissal is reversed where, applying the rule adopted in Perez v. Golden Empire Transit Dist. (2012) 209 Cal.App.4th 1228, plaintiff adequately alleged compliance with the Government Claims Act and the demurrer should have been overruled.
