In a civil action concerning a breach of contract claim, the trial court's judgment for defendant is affirmed where: 1) the trial court's refusal to grant plaintiff's motion for a settled statement under California Rules of Court, rules 8.130, 8.137, in the absence of a trial transcript that can be used on appeal, was an abuse of discretion; but 2) plaintiff forfeited the issue by failing to assert it in her petition for writ of mandate or opening brief.
