Convictions for assault likely to produce great bodily injury and sentences for assault with a deadly weapon and battery are vacated and reversed while the judgments are otherwise affirmed. The Court concluded that assault likely to produce great bodily injury was an alternative statement of assault with a deadly weapon, also charged, at the time the offense was committed in June 2008. The matter was remanded for resentencing and recalculation of two defendants' custody credits.
