In an injury and tort action, arising from injuries sustained by defendant's employees during a construction project, the trial court's sustaining of defendant employer's demurrer to the complaint of plaintiff contractor seeking contractual indemnification is reversed and remanded where allegations in the underlying lawsuit by defendant's employees against plaintiff contractor are not determinative of contractor's claim for indemnity in this action.
