Watson Bowman Acme Corp. v. RGW Construction, Inc., 070067
In a breach of a contract action, between a construction contractor defendant, the successful low bidder on a state highway project, and a project materials supplier plaintiff, alleging it was entitled to adjustment of price on defendant's original purchase order because the items ordered were changed, the trial court's judgment in favor of plaintiff is affirmed where: 1) the trial court correctly determined that defendant's purchase order was ambiguous; 2) the trial court correctly allowed the jury to evaluate the conflicting parol evidence before deciding the meaning of the contract; and 3) the price adjustment owed to Watson for the change in the order was sufficiently certain to meet the statutory requirements for an award of prejudgment interest.
