People v. Hamernik, 062401

Conviction for attempted possession of a controlled substance is reversed where: 1) the trial court erred by substituting the convicted offense for a possession of a controlled substance offense after dismissing the latter charge; 2) the error was not harmless; and 3) the error cannot be remedied by amending the information.
