People v. Vang, 075731

Conviction for arson of an inhabited structure is reversed where defendant's execution of the house's resident during a burglary removed the present intent to use the structure as a dwelling required by the statute. Defendant's conviction for first degree murder, burglary, robbery, and unauthorized taking or driving of a vehicle, and his life without possibility of parole sentence, are otherwise affirmed.
