In re Automobile Antitrust Cases I and II, 134913

In a state antitrust action, contending that defendant car manufacturers conspired to keep lower-priced, nearly identical new cars from being exported from Canada to the United States in order to keep California car prices artificially higher than in an otherwise competitive market, the trial court's grant of summary judgment to defendants Ford Motor Company and Ford Motor Company of Canada is affirmed in part and reversed in part where: 1) the trial court properly granted summary judgment to Ford Motor Company where there was insufficient evidence of an illegal agreement to curb exports; but 2) the trial court improperly excluded admissible evidence sufficient to raise a triable issue of material fact as to Ford Motor Company of Canada's participation in such an illegal agreement.
