California Court of Appeal
People v. Smith, 069445
Convictions for the first degree murder of a 90-year-old grandmother smothered to death with a pillowcase during a burglary are reversed where: 1) the trial court erred in instructing defendant Smith's jury that exculpatory testimony from an accomplice must be corroborated by additional evidence; and 2) the admission of statements defendant Smith purportedly made to acquaintances inculpating herself and defendant Mitchell should not have been admitted under California rules of evidence.
