California Court of Appeal
People v. Romo, 068255
Conviction for drug related offenses, arising from defendant's smuggling of a controlled substance into California from Mexico, is affirmed where the prosecutor's statement on the presumption of evidence did not constitute prosecutorial misconduct and the trial court correctly decided a number of evidentiary issues. The court directed that defendant's presentence credits be modified to account for a mistaken arrest date on the probation report used for sentencing, but otherwise affirmed.
