In an attorney's fees action, arising from a wage and hour dispute, in which the trial court awarded defendant Garcia attorney's fees as a prevailing party under Labor Code section 218.5 following plaintiff's judgment against other named defendants, the trial court's award of attorney fees is reversed where defendant Garcia does not qualify as a prevailing party under section 218.5 or Labor Code section 1194 under the circumstances.
