Conviction for misdemeanor petty theft is reversed and the case remanded for resentencing where: 1) there was insufficient evidence to prove that defendant's failure to pay a cab driver, after an argument developed over the fare, included the specific intent to defraud required for theft by false pretenses; and 2) the trial court's no contact probation condition is valid; and 3) the trial court is directed to recalculate and identify the statutory bases for any fines, fees, and penalty assessments imposed on remand.
