In a petition for resentencing under Proposition 47, concerning a sentence entered into pursuant to a plea bargain with the prosecution, the trial court's denial of the petition is reversed. The Court held that a defendant whose conviction is based on a negotiated plea, and who is otherwise eligible for resentencing under Proposition 47, may not be denied relief on the ground that reclassification of his or her conviction would reduce the bargained-for punishment of the plea.
