Sentence for conviction of criminal threats, Pen. Code section 422(a), battery, section 242, with true findings of a criminal street gang allegation applied to both offenses, is: 1) affirmed where sufficient evidence supports the jury's criminal street gang allegation findings, and the prosecution did plead or prove the prior strike conviction; but 2) modified where the trial court erred in its calculation of defendant's award of sentence credit.
