California Court of Appeal

Perez v. Torres-Hernandez, 139710

In a family law action, the trial court's denial of plaintiff's motion to renew her domestic violence restraining order against defendant is reversed where: 1) renewal did not require proof of abuse during the period when the restraining order was in effect; 2) defendant's violations of the order were abuse under the statute; 3) and the trial court improperly found abuse of plaintiff and defendant's children to be irrelevant.
