People v. Ocegueda, 041157

Sentence and conviction of attempted murder, assault with a firearm, and dissuading a witness, with firearm enhancements, are: 1) reversed and remanded for resentencing where the trial court erred by precluding the jury from considering evidence of defendant's mental disabilities in deciding whether he harbored the state of mind required for imperfect self-defense, but the error was harmless, and the Attorney General conceded the claim of sentencing error; and 2) affirmed over remaining claims of error regarding evidentiary, Miranda and sentencing range issues.
