California Court of Appeal

In re Miguel S., 052683

In a family law action, the juvenile court's order terminating the parental rights of the presumed father of Miguel S. and Robert S. and the biological father of Robert S. is reversed where: 1) insufficient evidence supports the juvenile court's finding that the federal Indian Child Welfare Act does not apply: and 2) the Social Services Agency failed to make active efforts to secure tribal enrollment for the children involved.
