California Court of Appeal
Kinda v. Carpenter, 040316
In an action brought by commercial tenants seeking a temporary restraining order and preliminary injunction against their landlord, alleging several contract related causes of action based on their lease and a defamation cause of action based on Yelp reviews that plaintiff suspected defendant was responsible for posting, the trial court's judgment and award of attorney's fees to defendant is reversed where the exclusion of the Yelp evidence and the resulting disposition of the defamation cause of action was error.
