California Court of Appeal
People v. Espino, 040942
Sentence and conviction for possession of methamphetamine for sale, possession of a firearm by a felon, and possession of ammunition by a felon are reversed where although the police had reasonable suspicion to extend the duration of the initial traffic stop beyond that necessary for traffic enforcement purposes, defendant did not give valid consent for the car search because the police lacked probable cause to keep him under arrest when they requested his consent.
