Sentence and conviction of first degree murder, with a true finding of an allegation that he personally used a weapon, in violation of Pen. Code sections 187(a), 189 and 12022(b)(1), are reversed where the trial court violated defendant's constitutional rights to a fair trial and to present a defense by improperly restricting the psychiatric testimony that he could introduce.
