Code section 187(a), and active participation in a criminal street gang, section 186.22(a), is: 1) reversed as to the murder count, where a number of factors, besides being confounding, resulted in prejudice to defendant in this close case; and 2) affirmed as to the active participation in a criminal street gang, where this count is not affected by the errors.
