McGee v. Balfour Beatty Construction, 262850

In a case concerning the application of Education Code section 17406, which governs lease-leaseback construction agreements, alleging the lease-leaseback agreements entered into by defendants were a sham to avoid the competitive bid process and are therefore void, the judgment of dismissal following the trial court's order sustaining defendants' demurrers without leave to amend is: 1) affirmed as to the section 17406 claim; and 2) reversed as to the conflict of interest claim and sanctions, where plaintiffs have alleged a cause of action for conflict of interest.
