In a suit brought by a plaintiff who was injured when his motorcycle was struck by a car owned by defendant and driven by defendant's daughter, in which defendants a joint Code of Civil Procedure section 998 offer that lapsed and the case went to trial and a jury returned a verdict for less than the section 998 offer amount, the trial court's orders that the 998 offer was valid, that the defendants could recover some expert witness fees and other costs and taxing certain of plaintiff's costs, are reversed where: 1) the 998 offer was not valid; and 2) the court erred in connection with its rulings on his cost items.
