California Court of Appeal

Brooks v. CarMax Auto Superstores, 067491

In a used car suit alleging auto dealer-defendant violated Vehicle Code section 11713.18, brought under California's Consumer's Legal Remedies Act (CLRA), Civ. Code section 750 et seq., and Unfair Competition Law (UCL), Bus. & Prof. Code section 17200 et seq., the trial court's judgment to defendant is affirmed where, although the trial court premised its judgment on plaintiff's lack of actual injury, the judgment is correct because both the content of the Certified Quality Inspection document (CQI Certificate) and the mode it was provided to plaintiff satisfied the requirements of section 11713.18(a)(6).
