Almanor Lakeside Villas Owners Assn. v. Carson, 041030

In a dispute between a homeowners association-plaintiff and homeowner-defendants, arising out of the defendants' leasing of properties as a short-term vacation rentals, the trial court's dismissal of defendants' cross-complaint and award of attorneys' fees to defendant is affirmed where: 1) the trial court's finding that the defendants failed to establish damages by competent evidence was sound, and the defendants have not shown that evidence presented to the trial court should have compelled a contrary outcome; 2) plaintiffs were the prevailing party for purposes of determining attorney's fees; 3) the award of attorney's fees, compared to the overall relief obtained by plaintiff, was so disproportionate as to constitute an abuse of discretion.
