In a wrongful death action against a city and police department brought by survivors of decedent who suffered fatal injuries when plaintiff's vehicle was struck by a suspect who was fleeing from police during a vehicle pursuit that lasted nearly 12 minutes, the trial court's grant of defendants' motion for summary judgment, on grounds they were immune from liability pursuant to Vehicle Code section 17004, is reversed where defendants failed to proffer sufficient evidence to establish as a matter of law that BPD promulgated its vehicle pursuit policy as required under section 17004.7.
