People v. Rogers, 077159

Convictions for assault with force likely to produce great bodily injury (GBI) simple assault along with an enhancement that defendant inflicted GBI under circumstances involving domestic violence were struck down where: 1) when a defendant has waived his or her right to a preliminary hearing, an information cannot thereafter be amended to add conduct enhancement allegations; and 2) despite these appropriate amendments, defendant suffered no prejudice so the original charges are affirmed.
