California Court of Appeal

Hernandez v. Restoration Hardware, Inc., 067091

In a class action, alleged retailer defendant committed numerous violations of Civil Code section 1747.08, also known as the Song-Beverly Credit Card Act, the trial court's final judgment finding defendant liable and awarding damages and attorney's fees is affirmed where plaintiff's argument, that merely filing a notice of appearance (and subsequently objecting to the attorney fee award) conferred standing on her to appeal from the court's judgment, must fail.
