Sentences for convictions of forcible rape in concert, Pen. Code section 264.1(a), forcible oral copulation in concert, former section 288a(d)(1), aggravated kidnapping, section 209(b)(1), assault by means of force likely to produce great bodily injury, former section 245(a)(1), second degree robbery, section 211, and willful, deliberate, premeditated attempted murder, sections 664 and 187(a), are: 1) modified as to defendants' presentence custody credits; 2) reversed in part where under section 667.61 as amended in 2006, defendants were not entitled to presentence conduct credits; 3) stayed as to the indeterminate aggravated kidnapping sentences, section 209(d), where this issue requires discussion of the jury instructions.
