In a wrongful death action involving a construction truck accident during a road paving project, the jury's special verdict that the driver was negligent but that his negligence was not a substantial factor in causing the harm suffered, is: 1) affirmed as to defendant CalPortland; 2) reversed as to the cost award to Michaelson & V&J Rock Transport and remanded for reconsideration in light of newly amended Code Civ. Proc. section 998(c)(1); and 3) affirmed in all other respects.
