California Court of Appeal

In re Donovan L., 068304

In a biological mother and her husband's appeal from the juvenile court's disposition order, that although husband was child's conclusively presumed father under Family Code section 7540, biological father was child's presumed father under section 7611(d), and child had three parents under recently enacted section 7612(c), the disposition order is reversed insofar as it determines biological father is child's presumed father under Family Code section 7612(c) and orders services and visitation for biological father where the juvenile court erred in applying section 7612(c) in this case, given its determination that biological father and child lacked an existing parent-child relationship.
