California Court of Appeal

People v. Cunningham, 063206

Sentence and conviction of attempted murder, Pen. Code sections 664 and 187, and robbery, section 211, with true findings as to the allegation defendant personally inflicted great bodily injury which caused the victim to become comatose due to brain injury, section 12022.7(b), are affirmed over defendant's contention that the evidence that the victim's treating physicians sedated her to conduct surgery and relieve pain associated with use of a respirator was insufficient evidence to support the jury's finding that the victim was comatose.
