Seacrist v. So. Cal. Edison, 061294
In a suit brought by plaintiffs who owned homes near defendant's substation, alleging negligence, nuisance, trespass, strict liability/products liability, strict liability/implied warranty of fitness, strict liability/ultra hazardous activity, and intentional infliction of emotional distress, the trial court's judgment is reversed where: 1) the California Public Utilities Commission (PUC) does not have exclusive jurisdiction over a case involving injuries resulting from stray electrical currents from a substation; and 2) the trial court has jurisdiction over the claims raised by plaintiffs.
