People v. Ramos, 050315

Convictions of transportation of heroin, Health & Saf. Code, section 11352(a), and possession of methamphetamine for sale, Health & Saf. Code section 11378, both with various firearm enhancements, are: 1) conditionally reversed as to the heroin conviction in light of a recent amendment to section 11352 that makes transportation for sale, i.e., non-personal use, an element of the charge, and remanded for further proceedings; but 2) affirmed as to the methamphetamine conviction where there is substantial evidence defendant possessed the methamphetamine with the requisite intent to sell it.
