California Court of Appeal
City of San Diego v. Super. Ct. (Dines), 068353
In a private party's suit for damages against a public entity under the California Government Claims Act, Gov. Code section 810 et seq., in which city-defendant denied the plaintiff's application for leave to file a late claim and plaintiff did not file her petition with the trial court for an order relieving her from the claims presentation for more than six months after City denied her application, the trial court's grant of plaintiff's petition, concluding section 915.2(b) gave her an additional five days to file her section 946.6 petition, is reversed where section 915.2(b) is inapplicable to, and does not extend, section 946.6's six-month limitations period for filing a petition with the court.
