California Court of Appeal

People v. White, 050478

Denial of petition for recall of defendant's indeterminate life sentence under Penal Code section 1170.126, which was enacted as part of the Three Strikes Reform Act, is affirmed over defendant's claims that: 1) the case the trial court relied upon, People v. White (2014) 223 Cal.App.4th 512, is inapposite; and 2) the disqualifying factor of being armed during the commission of the offense for which the indeterminate life sentence was imposed cannot apply to a mere possessory offense.
