People v. Superior Court (Rangel), 061292

In the People's petition for extraordinary relief challenging an order declining to place real party in interest on community supervision, Pen. Code section 3451(a) following his release from prison, the trial court's denial of the petition is affirmed where in enacting section 2900.5(a), the Legislature clearly recognized that persons who have served time in excess of that to which they were eventually sentenced should receive credit for that time against postrelease periods of restriction and control, and this rule should be extended to those facing community supervision.
