In a section 1983 claim against police officers and the city for a shooting of a minor who was carrying a toy gun, the jury verdict in favor of plaintiff finding that the deputy used excessive force and awarding him approximately $1.1 million in compensatory damage plus attorneys fees is reversed where the trial court erred in concluding that plaintiff's section 1983 claim was not barred under Heck v. Humphrey (1994) 512 U.S. 477.
