In an suit arising out of decedent's drowning near a dam, alleging the government was liable under Government Code section 835 because his death was caused by a dangerous condition of public property, the trial court's grant of summary judgment in favor of the Department of Fish and Wildlife (DFW) is affirmed where: 1) DFW was immune from suit under section 831.2; and 2) it did not own or control the dam remnant.
