Harrison v. City of Rancho Mirage, 062604

In a challenge to a municipal ordinance that provided rules and regulations for renting private homes as short-term vacation rentals, the trial court sustainment the demurrer without leave to amend is affirmed where: 1) the complaint did not sufficiently state facts to constitute a cause of action for a violation of the Unruh Act; and 2) the complaint cannot now be amended to claim a violation of Government Code section 65008, especially considering plaintiff refused to amend the Complaint in the trial court.
