California Court of Appeal

People v. Burton, 061187

Conviction of first degree murder is affirmed where: 1) intimate partner battery, in violation of Penal Code section 273.5, is a crime of moral turpitude; and 2) because defendant's prior convictions for violating section 273.5 involve crimes of moral turpitude, defense counsel’s failure to object to their admission for impeachment purposes did not constitute inadequate representation.
