California Court of Appeal

Nationwide Mutual Ins. v. Shimon, 071776

In an insurance coverage case, arising when a 17-year-old driver got into a motor vehicle accident, injuring two people, while driving an uninsured vehicle, the trial court's entry of declaratory judgment of no coverage in favor of insurer is affirmed where: 1) the vehicle was furnished or available for the minor driver's regular use and therefore coverage was excluded; and 2) the vehicle was therefore not eligible for non-owned-auto insurance coverage.
