Javorsky v. Western Athletic Clubs, Inc., 142254
In a suit brought against a health and fitness club under the Unruh Civil Rights Act, Civil Code section 51 et seq., and the unfair competition law (UCL), Bus. & Prof. Code section 17200, the trial court's ruling, that the club did not violate the Unruh Civil Rights Act by charging persons ages 18 to 29 a lower membership fee than it charged persons age 30 and over, is affirmed where the practice was not arbitrary, unreasonable, or invidious discrimination.
