California Court of Appeal

Schneer v. Llaurado, 060040

In a father's appeal of an order of the family court finding California lacks jurisdiction under the Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA), Fam. Code section 3400 et seq., to make an initial child custody determination regarding his daughter, the order is reversed where: 1) the court erred by ruling California was not the child's home state for purposes of the UCCJEA because the child did not reside in California during the six-month period immediately before father filed his child custody petition; and 2) California is the child's home state because the child resided in California for six continuous months and was taken to Florida by her mother, defendant, less than six months before father filed his petition.
