In a Proposition 47 petition for resentencing for conviction of second degree commercial robbery with intent to commit larceny, denial of the petition is reversed as to counts 1-5 and the matter remanded to the trial court with directions to issue a new order changing appellant’s commercial burglary offenses, Pen. Code section 459, to misdemeanor shoplifting, section 459.5.
